This research aims, first of all, to establish that Abû Hanîfa's (d. 150/767) positive view on the issue of performing wudû’ with nabîdh of date is correct, and then to reveal Abû Hanîfa's dalîls on this subject. The issue of wudû’ with nabîdh of date is controversial among early Hanafî jurists, and the jurist who expressed a positive opinion on this issue is Abû Hanîfa, the founding imam of the madhhab. The opinion that wudû’ can be performed with nabîdh of (...) date is the strong opinion of Abû Hanîfa mentioned in zâhir al-riwâya. The riwâya reported by Nûh bin Abi Maryam (d. 173/789) stating that Abû Hanîfa reneged on this view is not strong enough to oppose the view in zâhir al-riwâya. For this reason, it is not a correct approach to ignore the view in zâhir al-riwâya based on this riwâya. As a matter of fact, Abû Hanîfa's view of zâhir al-riwâya is conveyed in many of the classical Hanafî texts such as Mukhtasar al-Karkhi and Mukhtasar al-Tahâwî. Although the majority of Hanafî jurists preferred the view of Abû Yûsuf (d. 182/798), a significant group of Hanafî jurists such as Jassâs (d. 370/981), Kâshânî (d. 587/1191) and ‘Aynî (d. 855/1451) He supports Abû Hanîfa's view. Therefore, there are two views on the issue in Hanafî fıqh. In the literature, the dalîls of Abû Hanîfa's view is not available as a whole in a single source, but is scattered in many Hanafî fiqh sources. The Hanafî jurist Jassâs is the one who deals with the mentioned dalîls in the most comprehensive way in his many works. For this reason, the subject was examined by focusing on Jassâs's dalîls. Jassâs' istidlâls regarding the issue of wudû’ with nabîdh of date also mean defending Abû Hanîfa against other Hanafî jurists such as Abu Yusuf and Imâm Muhammad (d. 189/805). Jassâs' insistent attitude on this issue and his passionate counter-answers prove how much he deserves the title of defense. For the relevant determination, Hanafî fiqh classics are centered. Because the jurists who argue that wudû’ can be made with the nabîdh of date are among the Hanafî jurists. Then, the positive and negative approaches of the jurists about the nabîdh of date are given. Starting from the early Hanafî jurists, the views of the sahâbîs, the tâbi'ûn and many later jurists on the subject are included. The approach of the four madhhabs of fiqh is also examined in this section. Then, the istidlâls of Jassâs, which is the main subject of the research, were emphasized. It is seen that Jassâs' istidlâls have three main pillars: âya, hadîth and idjma. As a âya, the 6th âya of the sûra of Mâida, as a hadîth, the hadîth of ‘Abd Allâh bin Mas'ûd (r.a.) and as a idjma, the the sahâbîs idjma tries to showas references. The most controversial dalîl is undoubtedly the hadiths of Ibn Mas'ud (r.a.). Jassâs opposes those who claim that the hadîth is da‘îf and discusses the hadîth with its detailed tarîks and argues that this hadîth is sahîh. (shrink)

This study aimed to produce a model of integration between theology (reformed) and ideology ( Pancasila ) to realise a just and civilised humanity (second sila of Pancasila ). This research is based on the paradigm of naturalism with qualitative methods and the approach applied is historical and integrative. The research results produced an integrative model between Reformed Theology and the ideology of Pancasila that rejects the understanding and practice of capitalism, religious fundamentalism, communism, and racism. This study pointed out (...) that these four understandings and practices contradict the basic principles of a just and civilised humanity based on theological and ideological studies. Contribution: This study produced four fundamental clues for all Indonesian citizens, especially Christians, namely the source, basis, pillars, and dual role as citizens and kingdoms of God in the fight for the formation of a just and civilised humanity. The movement for the revival of the Scholastic tradition (Neo-Scholasticism) was a reaction to devastating criticism by the representatives of Enlightenment which led to the destruction of traditional metaphysics and of epistemological optimism, the two pillars of European religious philosophy. Reception of Kantian ideas in Neo-Scholasticism varied from total rejection to its use in renewing the philosophical foundation of religious philosophy. In this regard the legacy of the Polotsk Jesuit Academy was one of the first attempts to interpret Kant’s ideas (...) and confront them in the framework of the Scholastic tradition. It is therefore not irrelevant to look at how Kant’s programmatic ideas were perceived at the Polotsk Jesuit Academy, one of the few centres of Jesuit philosophy that survived in the territory of the Russian Empire in the early nineteenth century. The object of this study is the attempt at a critical analysis of Kant made in the Philosophical Instructions for Students at the Polotsk Academy by the Academy’s professor, Giuseppe Angiolini. Angiolini constantly refers to Kant in his reasoning and sees him as his main ideological rival. The ideas articulated in the Philosophical Instructions influenced the philosophical positions of the Academy’s graduates who in turn made a tangible contribution to the development of the Belarusian intellectual tradition. The relationship between Kant’s ideas and the ideas Angiolini drew from the Scholastic tradition is analysed through the use of the concepts that are common to both trends, such as the transcendental, the empirical and the sensible, self-evident truths and common sense. The creation of new institutions and the initiation of new forms of behaviour cannot be explained only on the basis of constitutive rules – they also require a broader commitment of individuals who participate in social practices and, thus, to become members of a community. In this paper, I argue that the received conception of constitutive rules shows a problematic intellectualistic bias that becomes particularly manifest in three assumptions: (i) constitutive rules have a logical form, (ii) constitutive rules have no (...) normative force, and (iii) rules are essentially tied to a sanctioning authority. I discuss these three claims in light of real-life examples. The goal of this discussion is to show that the normative force of constitutive rules is based on the shared commitment of participants who engage in the relevant practices. The inner cohesion and the persistence in time of these practices is possible only because participants continuously calibrate their own forms of behaviour to that of the other members of the community, which underscores the social dimension of constitution. In this article I examine corporate social reporting as a form of New Governance regulation termed “democratic experimentalism.” Due to the challenges of regulating the behavior of corporations on issues related to sustainable economic development, New Governance regulation—which has a focus on decentralized, participatory, problem-solving-based approaches to regulation—is presented as an option to traditional command-and-control regulation. By examining the role of social reporting under a New Governance approach, I set out three necessary requirements for social reporting to be effective: disclosure, (...) dialogue with stakeholders, and the moral development of the corporation. I then assess current social reporting practices against these requirements and find significant problems. In response, I propose one option for solving those problems, and encourage future researchers to consider the demands of these three requirements and the possible trade-offs between them when attempting to find ways to improve social reporting practices. He gave a lecture entitled, "Faith and Culture." Pope St. John Paul II had only back in September of the previous year published his momentous encyclical Fides et Ratio. Purposely placing his own remarks under the umbrella of that encyclical, Cardinal Ratzinger used the opportunity (...) at St. Patrick's Seminary to discuss the growing relativism which was even at that time eroding our culture.He began his lecture by using an example from C. S. Lewis's great work The Screwtape Letters. The future Pope remarked:This book consists of fictional letters from a senior devil who is giving advice on how best to proceed to one beginning in the work of leading men astray. The younger devil has expressed concern to his superior that especially intelligent people, in particular, might read the books of wisdom of the ancients and might thus come upon the track of the truth. Screwtape calms him by pointing out that the "Historical point of View," with which the intellectuals of the Western world have fortunately been inculcated by the devils, means in fact that "when a learned man is presented with any statement in an ancient author, the one question he never asks is whether it [End Page 7] is true. He asks who influenced the ancient writer, and how far the statement is consistent with what he said in other books, and what phase in the writer's development, or in the general history of thought, it illustrates, and how it affected other writers," and so on.1The startling truth is that now, almost twenty-five years later, what Cardinal Ratzinger articulated back in 1999 has only crystallized. In almost every area of our culture, the notion of truth has receded due to the acidic encroachment of relativism. As a culture we have given up on any hope of finding truth and instead consigned reality to something that is determined by the individual. We see the extent to which this relativism has taken hold of our culture in the now-famous words of Supreme Court Justice Anthony Kennedy: "At the heart of liberty is the right to define one's own concept of existence, of meaning, of the universe, and of the mystery of human life."2 In this breathtaking statement, Justice Kennedy seemingly makes irrelevant the entire history of Western civilization. The irony, of course, is that it is precisely the course of Western philosophy and thought which has steered the culture in such a direction that it could produce a Supreme Court justice who would articulate such a bewildering statement. For we do not, nor can we, exist in a philosophical vacuum. And such is the great irony of this moment that we occupy—it is on the ash heap of Western civilization that relativists stand attacking the very history which brought them to be there in the first place.Given this sad reality, we can see Cardinal Ratzinger's criticism from 1999 as a clarion call, and as prophetic in describing what has transpired in the decades since. The complete dominance of relativism in all its forms demands that we return to the primacy of truth. But it is not only unfettered relativism that necessitates this return to truth. The return to the splendor of truth becomes all the more important for us as Christians. As the First Letter of St. Peter makes clear, the Christian is to purify his soul by obedience to the truth (1 Pet1:22). And in the Gospel of St. John, we are told that Christ is the true Light who enlightens all, and who gives the power to become children of God to those who receive him (John 1:9–11).In this vein, I would like to present what I believe is the strength of Catholic education and the need to restore a truly Catholic vision. Berkeley subscribed to the principle of heterogeneity, that what we see is qualitatively and numerically different from what we touch. He says of this principle that it is “the main part and pillar of [his] theory.” The argument I present here is that the theory to which Berkeley refers is not just his theory of vision, but what that theory was the preparation for, which is nothing less than his idealism. The argument turns on the passivity of perception, which (...) is what is at stake in the principle of heterogeneity. I propose the next steps in the neuropragmatic approach to philosophy that has been advocated by Solymosi and Shook. My focus is the initial process of inquiry implicit in addressing philosophical questions of cognition and mind by utilizing the tools of neuroscientific research. I combine John Dewey’s pattern of inquiry with Charles Peirce’s three forms of inference in order to outline a methodological schema for neuropragmatic inquiry. My goal is to establish ignorance and guessing as well-defined pillars of methodology upon (...) which to build a neuropragmatic approach to inquiry. First, I outline Dewey’s pattern of inquiry, highlighting the initial problematic phase in which recognized ignorance provides the basis upon which to frame a philosophical problem and initiate the trajectory by which philosophical questions may be addressed with the assistance of neuroscientific evidence. Second, I provide an outline of Peirce’s three forms of inference, focusing upon the first phase of abduction: guessing. Third, I explain the transition between ignorance and guessing, urging the benefit of attending to these two aspects of inquiry. Finally, I provide an initial sketch indicating the next steps concerning a pragmatic reconstruction of neurophilosophy, pointing towards the need for a more thorough examination of scientific methodology within and following analyses of philosophical problems and neuroscientific evidence. Individuals can only be picked out under some sortal, a concept which provides principles of individuation and identity. Many advocates of this view have argued that object is not a genuine sortal concept. I will argue in this paper that a narrow sense of‘object’, namely the concept of any bounded, coherent, three‐dimensional physical object that moves as a (...) whole (Spelke, 1990) is a sortal for both infants and adults. Furthermore, object may be the infant's first sortal and more specific sortals such as cup and dog may be acquired later in the first year of life. I will discuss the implications for infant categorization studies, trying to draw a conceptual distinction between a perceptual category and a sortal, and I will speculate on how a child may construct sortal concepts such as cup and dog. I hope that this wonderful book, written with a passionate and sympathetic intelligence, reaches a wide audience. It's not an easy read, for Janice Haaken deliberately spins a dense web of reference, pursuing paths across the contemporary psycho-political landscape. But her scholarship is marvellously diverse and well-directed, and her writing easily shifts between sad or playful fantasy, and insistently engaged political or empirical analysis.

This article explores the relationship between skin, ego and second skins. It does so conceptually by re-examining Freud’s suggestion, in The Ego and the Id, that the ego is first and foremost a bodily entity, while also being a projection of a surface (i.e. skin). Drawing upon Anzieu, a dynamic model of inter-weaving surfaces can be seen to underpin an understanding of the ego — and skin ego. This model is fundamentally spatialized. Even so, an appreciation of the spatialities of (...) skin and ego can be developed further. To illuminate these spatialities, this article examines two key experiences of T.E. Lawrence during his military service in Arabia (c. 1917), as he describes them in his autobiographical account Seven Pillars of Wisdom. In a meeting with British military police, and in the notorious Deraa rape incident, what is at stake is Lawrence of Arabia’s skins. Reading these experiences using Freud and Anzieu, the article argues that these events re-present an ongoing chafing of Lawrence’s skin, ego and second skins, which can be called his ‘skin of suffering’. The traditional theory of the just war comprises two sets of principles, one governing the resort to war and the other governing the conduct of war. One of the central pillars of the traditional theory is that the two set of principles are, in Michael Walzer ’ s words, “ logically independent. It is perfectly possible for a just war to be fought unjustly and for an unjust war to be fought in strict.

Projections for replacement rate achievable from two mandatory pillars of the pension system indicate a significant reduction in retirement income compared to regular professional activity. The designers of the new philosophy of retirement have made an assumption that all three pillars will play equivalent role in providing retirement income. They have also assumed that the participants of the pension system will be kept informed about the height of the expected benefits derived from the first pillar and the amount of (...) funds raised in the second pillar. Forecast of low (unsatisfactory) benefits from a compulsory part of the system is supposed to persuade people to make informed decisions aimed at increasing retirement income. (shrink)

In this article we consider certain elements of the normative theory of Jürgen Habermas in the light of the proposals of Bruce Ackerman, with a view to strengthening a concept of deliberative democracy applied to the legitimation of juridical rules. We do not construct a hierarchy of the two positions, but seek to bring together certain elements to achieve a common project. As the starting point for examining the work of the two authors, we take the scheme proposed by Habermas (...) in Faktizität und Geltung. In this connection, through the work of Ackerman, we intend to fill in some of the gaps that Habermas appears to have left in the theory of radical democracy applied to the law. The work of Ackerman can make a significant contribution to deliberative democracy, to the discourse principle that Habermas defines, and to the contractualist theories from a liberal perspective. The study of these contributions makes possible a critical judgment that enables the legitimation of juridical rules carried out by Habermas to acquire greater practicity. In examining the epistemological status of juridical science and law, we attempt to determine the weight and the performance of normative democracy. In Tarr's view, it is a matter for philosophers to examine direct democracy and its desirability. (shrink)

The work of cognitive psychologists, philosophical naturalists, post-modernists, and other such epistemic subversives conspires to endanger the well being of traditional analytic epistemology. Stephen Stich ( et tu Stich) has contributed his design for epistemology's coffin. I look hard at his proposed radical revision of epistemology. The ostensible target of Stich's analysis is the traditional enterprise of analytic epistemology. It is, however, the conceptual pillars that underpin both the traditional analytic and naturalist epistemologies that are the primary focus. It is (...) a conceptual domain neutral to the priorists and naturalists which Stich calls normative cognitive monism . Normative cognitive monism is the view that there is a unique system of cognitive processes that people should use. The point of Stich's analytical exercise is to disabuse us of the belief that there is such a unique and global set of standards by which cognitive performance is to be evaluated. He argues that all the evidence, both empirical and conceptual, leads away from this ultimately chauvinistic view and converges on normative cognitive pluralism which is the denial of monism. The same evidence that informs normative cognitive monism confirms normative cognitive pluralism. The empirical evidence is provided by the results of celebrated experiments on reasoning, or as Stich calls it, cognitive performance. The conceptual evidence derives from the failure of naturalistic accounts of intentional content. Stich's (1983) derisive view of theories of intentional content adumbrated in From Folk Psychology to Cognitive Science is now the linchpin of his pragmatic theory of cognitive evaluation. (shrink)

[Time, the fundamental dimension of our existence, has fascinated artists, philosophers, and scientists of every culture and every century. All of us can remember a moment as a child when time became a personal reality, when we realized what a "year" was, or asked ourselves when "now" happened. Common sense says time moves forward, never backward, from cradle to grave. Nevertheless, Einstein said that time is an illusion. Nature's laws, as he and Newton defined them, describe a timeless, deterministic universe (...) within which we can make predictions with complete certainty. In effect, these great physicists contended that time is reversible and thus meaningless. (shrink)

The rule of Continuous Improvement is one of the pillars of the concept of Total Quality Management. It states that one should continuously seek the sources of arising problems and eliminate or minimize them. The article presents a method of implementing the concept of Corporate Social Responsibility based on the above rule and afterwards it identifies the most important advantages of using the rule. The article also stresses its usefulness in the area of Small and Medium-sized Companies.
